Welcome to BlockDistraction! These Terms of Use ("Terms") govern your access to and use of the BlockDistraction browser extension (the "Service") and our website https://blockdistraction.com (the "Site").

The Service and Site are operated by Sole Proprietor Markov Oleksandr Ivanovich, doing business as "Mark Digital" ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms.

Please read these Terms carefully. By creating an account, purchasing a subscription, or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

1. Description of Service

BlockDistraction is a browser extension designed to help users improve their focus and productivity by blocking distracting websites.

• Free Version: The Service offers a free version with core features, including basic website blocking and strict mode.
• Pro Subscription ("Pro"): We offer a paid subscription that unlocks advanced features, which may include but are not limited to: scheduled blocking, password protection, Universal License (Desktop & Mobile), rule import/export, and usage statistics.

2. User Accounts

To access Pro features, you must create an account.

• Account Creation: You can create an account directly by providing an email and password, or through a third-party service like Google. If you purchase a subscription without an existing account, one will be created for you based on the email provided during checkout.
• Account Responsibility: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
• Accurate Information: You agree to provide true, accurate, and complete information when creating your account and making a purchase.

3. Subscriptions, Payments, and Refunds

All payments for Pro subscriptions are processed by our third-party payment processor and Merchant of Record, Paddle.com Market Ltd ("Paddle"). Your purchase is subject to Paddle's own terms and privacy policy.

• Subscription Plans: We offer various subscription plans (e.g., Monthly, Annual) and a one-time purchase for a Lifetime plan. Prices are listed on our Site.
• Free Trial: We may offer a free trial for our subscription plans. If you do not cancel before the trial period ends, you will be automatically charged for the subscription.
• Billing: For subscription plans, you will be billed on a recurring basis (monthly or annually) until you cancel. You can manage or cancel your subscription through the Paddle customer portal or by contacting our support.
• Refunds: We offer a 14-day money-back guarantee for all new purchases. If you are not satisfied with the Pro subscription, please contact us at [email protected] within 14 days of your purchase for a full refund.
• Price Changes: We reserve the right to change the price of our subscription plans. We will provide you with reasonable prior notice of any price changes.

4. Acceptable Use Policy

You agree not to misuse the Service. For example, you must not:

• Attempt to reverse engineer, decompile, or disassemble the Service.
• Use the Service for any illegal or unauthorized purpose.
• Attempt to gain unauthorized access to our servers or user accounts.

• By Us: We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. If we terminate your account without cause, and you have a paid subscription, we may offer a prorated refund. We will not provide a refund if we terminate your account for a violation of these Terms.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BLOCKDISTRACTION, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

9. Software Updates & Compatibility

The Extension relies on the Google Chrome / Firefox platform APIs. We are not responsible for functionality issues caused by changes in third-party platform policies (e.g., Chrome Web Store Manifest V3 updates) or browser updates that are beyond our control.

10. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which can be found at https://blockdistraction.com/privacy.html.

11. Changes to Terms

We may modify these Terms from time to time. If we make material changes, we will notify you (for example, by email or by posting a notice on our Site). Your continued use of the Service after the changes have been implemented constitutes your acceptance of the new Terms.
